1. Who we are
This website is operated by El M’Barki Real Estate B.V. (“El M’Barki Real Estate”, “we”, “us”), a real estate investment and development company. We are the controller of the personal information described in this policy. This policy also covers enquiries made through the El M’Barki Foundation pages of this website.
2. What information we collect
Depending on how you interact with us, we may process:
- your name;
- your organisation or company;
- your email address;
- your telephone number, if you provide it;
- information about an enquiry, opportunity or project you share with us;
- commercial leasing requirements, such as intended use, desired area and floor preference;
- information you provide in a Foundation enquiry;
- project documents you choose to upload, where a form allows this;
- basic technical and security information, such as IP address, browser and device type, and server logs where these are generated.
Please do not include special categories of personal data in your messages or documents.
3. How information is collected
- through the forms on this website;
- through direct communications with us, such as email or telephone;
- through the normal technical operation of the website and its hosting infrastructure.
4. Why we use information
- to respond to your enquiry;
- to assess investment, development or strategy opportunities you share with us;
- to follow up on commercial leasing enquiries;
- to handle Foundation partnership and support communications;
- to keep the website secure and to prevent spam and abuse;
- to comply with legal obligations.
5. Legal bases
Under the General Data Protection Regulation (GDPR) we rely on:
- taking steps at your request before entering into a contract, where your enquiry relates to a potential agreement;
- our legitimate interests in responding to business enquiries, assessing opportunities, and operating and securing this website;
- your consent, where specifically required, which you may withdraw at any time;
- compliance with a legal obligation, where applicable.
6. Sharing and processors
We share personal information only where necessary, with:
- hosting and infrastructure providers that run this website;
- email delivery providers that transmit form submissions to us;
- font service providers whose content is loaded on this website;
- professional advisers, such as lawyers or accountants, where necessary;
- authorities, where required by law.
Our service providers act on our instructions. We do not sell personal information.
7. International transfers
Some of our suppliers may process personal information outside the European Economic Area. Where this happens, we rely on appropriate safeguards, such as an adequacy decision or the European Commission’s Standard Contractual Clauses.
8. Retention
We keep personal information only for as long as reasonably necessary for the purposes described above, including handling your enquiry, any resulting relationship, our legal obligations and the security of the website. Information that is no longer needed is deleted or anonymised.
9. Security
We use appropriate technical and organisational measures to protect personal information, including encrypted connections, server side validation of form submissions and restricted access. No method of transmission or storage is completely secure, but we work to protect your information against loss and unauthorised access.
10. Your rights
Subject to the conditions of the GDPR, you have the right to:
- access your personal information;
- have inaccurate information rectified;
- have your information erased;
- restrict processing;
- object to processing based on our legitimate interests;
- data portability, where applicable;
- withdraw consent at any time, where processing is based on consent.
You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or the supervisory authority in your country.
11. Cookies and analytics
This website does not currently use analytics or marketing cookies. Essential technical functionality, such as delivering pages securely and remembering a choice you make on the site, may operate without consent where the law permits. Fonts are delivered by Adobe Fonts, which receives technical information such as your IP address when the font files load. The MIX Amsterdam leasing page uses a static location panel, not an embedded map. No Google resources load merely by visiting that page. Google Maps is contacted only if you choose to open its external location link, where Google’s own privacy and cookie terms apply.
If we introduce analytics in the future, non essential analytics will not run until you have given any required consent, and this policy will be updated.
12. Third party links
This website may link to websites operated by others. We are not responsible for their content or privacy practices. Please read their policies before sharing information with them.
13. Changes to this policy
We may update this policy from time to time. The date at the top of this page shows when it was last revised.
